Terms of Service

By downloading, installing, or using Never Have I Ever: Mask Off (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

The App is operated by Michał Kulecki (“we”, “us”, or “our”).

The App is intended for users aged 17 and older. By using the App, you confirm that you meet this age requirement. If you are under 17, you may not use the App.

Never Have I Ever: Mask Off is a social party game featuring themed question decks. The App is designed for entertainment purposes and is intended to be played in a group setting. The questions and statements in the App are meant for fun and should not be taken as advice, recommendations, or endorsements of any behavior. The App does not require user accounts or registration. Some features of the App may require an internet connection to function properly.

The App offers both free and premium content. Premium content is available through in-app purchases, including subscriptions and one-time lifetime purchases.

All purchases are processed by Apple through the App Store and are subject to Apple’s terms and conditions. We do not collect or store any payment information.

Subscriptions:

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

• You can manage or cancel your subscription at any time through your Apple ID settings.

• You may also restore purchases at any time using the “Restore Purchases” option within the App.

• Refund requests must be submitted to Apple, as all payments are processed by Apple. Refund eligibility is determined by Apple and applicable law.

Free trials:

• If offered, free trials automatically convert to a paid subscription at the end of the trial period unless canceled beforehand.

• Unused portions of a free trial are forfeited upon purchasing a subscription.

For refund requests, please contact Apple Support directly, as all billing is handled by Apple.

You agree to use the App only for its intended purpose as a social entertainment game. You agree not to:

• Use the App for any unlawful or harmful purpose

• Attempt to reverse-engineer, decompile, or disassemble the App

• Modify, adapt, or create derivative works based on the App

• Remove or alter any proprietary notices, labels, or marks in the App

• Use the App in any way that could damage, disable, or impair the service

• Attempt to gain unauthorized access to any systems or data related to the App

Use the App responsibly and in a manner that does not endanger yourself or others.

All content in the App, including but not limited to text, questions, graphics, icons, illustrations, designs, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

The App contains questions and statements designed for entertainment in social settings. Some content may reference adult topics such as alcohol, relationships, or social situations.

We do not encourage or endorse any illegal, harmful, or irresponsible behavior. Users are responsible for how they choose to engage with the content and should always act within the boundaries of the law and personal safety.

Content filters are available within the App to adjust the type of content displayed.

The content provided in the App is for entertainment purposes only and should not be considered professional, medical, or legal advice.

The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of or inability to use the App.

Our total liability for any claims related to the App shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time without prior notice. We may also update content, features, and pricing at our discretion.

We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

The App uses third-party services including RevenueCat, PostHog, Sentry, and Supabase. Your use of the App is also subject to their respective terms and privacy policies.

We are not responsible for the practices or content of any third-party services.

We may restrict or terminate your access to the App at any time if you violate these Terms, without prior notice or liability.

Upon termination, your right to use the App ceases immediately. Sections regarding intellectual property, disclaimers, limitation of liability, and governing law survive termination.

These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.

Any disputes arising from these Terms or the use of the App shall be resolved by the competent courts in Poland.

We may update these Terms from time to time. Changes will be posted within the App or on our website with an updated “Last updated” date. Continued use of the App after changes constitutes acceptance of the revised Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
